This Privacy Policy describes how David Smith, operating under the name Nocturnal Vision, handles personal information in our mobile apps and games. We respect your privacy and are committed to transparency about the data we collect and how it is used.
1. Apps Covered by This Policy
This policy applies to all apps developed and published by David Smith under the Nocturnal Vision name, including but not limited to:
- Smash'em Up! (mobile game - version 1.1.0)
- Carrots (mobile app)
- QLoop (mobile app)
- SliceSum (mobile game)
Each app may have different data practices, detailed below.
2. Smash'em Up!
2.1 Information We Collect
Information We Collect Directly:
Our app collects minimal data, all stored locally on your device:
- Game Progress: High scores, level completion, challenge progress
- Settings Preferences: Sound volume, haptics settings, difficulty preferences
- In-Game Currency: Chits earned and spent
- Mod Purchases: Which mod tiers you've purchased (stored locally)
Important: This data is stored only on your device and is not transmitted to our servers. We do not have access to this information.
Information Collected by Third Parties:
When you choose to watch a rewarded video ad, Google AdMob may collect:
- Device advertising identifier (Advertising ID on Android, IDFA on iOS)
- IP address and general location (country/region only)
- Device information (device model, operating system version)
- App usage data (which ads you viewed, app session duration)
- Ad interaction data (whether you clicked or closed an ad)
Information We Do NOT Collect:
- Name, email, or contact information
- Photos, camera, or microphone access
- Precise location data
- Contacts or social network connections
- Payment information (in-app purchases are handled by App Store/Google Play)
2.2 Advertising
Smash'em Up! uses non-personalized advertisements only. This means:
- Ads are based on the content of our app (a family-friendly game), not your personal browsing history or behavior
- No cross-app or cross-website behavioral tracking
- No creation of advertising profiles based on your interests
- Safe for all ages, including children under 13
- We design Smash’em Up! to support COPPA compliance by using non-personalized ads and avoiding collection of personal information from children under 13.
Rewarded Video Ads:
Smash'em Up! displays optional rewarded video advertisements that allow you to unlock Smash Tech mod tiers without spending in-game currency. Watching ads is completely optional - you can also unlock features by:
- Earning Chits through gameplay (killing bugs, achieving high scores)
- Completing in-game challenges
- Using Unlock Tokens earned by mastering difficulty levels
Ad Provider:
We use Google AdMob to serve advertisements. AdMob is operated by Google LLC and processes data according to Google's privacy policy. The data collected by AdMob is used to:
- Display relevant advertisements (based on app content, not personal behavior)
- Measure ad performance and prevent fraud
- Comply with legal obligations

2.3 Your Advertising Choices
You can control advertising preferences on your device:
iOS:
- Settings → Privacy & Security → Tracking → [Toggle off for Smash'em Up!]
- You can also review ad-related privacy settings in your Apple account and device settings.
Android:
- Manage ad personalization and reset/delete your advertising ID in your device privacy settings (wording may vary by device and Android version).
Note: Even if you opt out or reset your advertising ID, you will still see ads when you choose to watch them for in-game rewards. However, they will not be based on your interests or behavior.
2.4 Children's Privacy (COPPA Compliance)
Smash'em Up! is rated for ages 9+ and is safe for children. We take additional steps to protect young users:
- Non-personalized ads only (as described above)
- Family-friendly ad content filtering through AdMob's Family Ads program
- Maximum ad content rating set to PG (Parental Guidance)
- No collection of personal information from children under 13
- Ads are configured to support COPPA compliance
We design our app to support compliance with the Children's Online Privacy Protection Act (COPPA). For users under 13:
- We do not collect personal information
- We use non-personalized ads only
- We do not create profiles or track behavior
- We do not share data with third parties (except AdMob for serving ads)
If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@nocturnal-vision.com, and we will promptly delete it.
2.5 Data Retention and Security
Data Stored Locally:
Game progress, settings, and in-game currency are stored on your device and persist until you uninstall the app. You can delete this data at any time by uninstalling the app.
Data Collected by AdMob:
AdMob retains advertising data according to Google's data retention policies. We do not directly store, access, or control the advertising data collected by AdMob.
Security Measures:
- We rely on platform-provided app sandboxing and operating system protections for locally stored data
- We do not transmit personal data to our servers
- AdMob uses industry-standard security measures to protect advertising data
3. Carrots
To provide account functionality and a personalized experience, Carrots may collect limited user information:
- Information collected: name and email address (during account creation or login).
- Purpose: used only to create and manage your account.
- Sharing: We do not sell your personal information. We may share information with service providers that help us operate the app (such as hosting, authentication, notifications, or support tools), but only as needed to provide and improve the service. We do not share your information with third-party advertisers for targeted advertising.
- Security: data is stored securely and encrypted during transmission.
- Data deletion: request account or data deletion anytime at support@nocturnal-vision.com.
4. QLoop
QLoop does not collect, store, or transmit any personal data. All app data is stored locally on your device.
- Information collected: none.
- Advertising: QLoop does not display advertisements.
- In-app purchases: QLoop offers an optional premium upgrade processed entirely by Apple (App Store) or Google (Google Play). We do not collect or have access to your payment information.
- Data deletion: uninstall the app to remove all locally stored data.
5. SliceSum
5.1 Information We Collect

Google AdMob collects the following information to serve personalized advertisements:

5.2 Advertising
SliceSum uses personalized advertisements. This means:
- On iOS, we request permission through Apple’s App Tracking Transparency (ATT) framework before allowing tracking for personalized advertisements. If permission is denied, you may still see ads, but they may be non-personalized and not based on your interests or behavior.
- Ads are tailored based on your browsing history, app usage, and interests
- Cross-app and cross-website behavioral tracking may occur
- Advertising profiles may be created based on your activity
- SliceSum is not intended for children under 13 due to personalized ad targeting
Ad Formats:
SliceSum displays the following types of advertisements:
- Banner Ads: Small advertisements displayed during gameplay
- Interstitial Ads: Full-screen advertisements displayed between levels or game sessions

Depending on the app and feature you use, our legal bases may include:
- Performance of a contract – to provide app functionality you request (such as core app features, local save data, or account access in Carrots).

- Consent – where required, including for certain advertising and tracking activities (such as personalized ads in SliceSum).

The legal basis may vary depending on the app and the type of data involved. For example, SliceSum advertising and tracking-related processing may rely on your consent where required by law.
7. Your Rights and Choices
For All Apps:
- Delete any app at any time to remove local data from your device
- Request information about data we collect
- Request deletion of your data
For Smash'em Up! Specifically:
- Manage device privacy and advertising identifier settings on your device (see the Smash'em Up! advertising section above). Smash'em Up! uses non-personalized ads only.
- Earn all in-game rewards without watching ads (play the game to earn Chits)
- Uninstall the app to delete all locally stored data
For SliceSum Specifically:
- Opt out of personalized ads via device settings (see section 5.3)
- Uninstall the app to delete all locally stored data
GDPR (European Users):
If you are located in the European Economic Area (EEA), you have additional rights under the General Data Protection Regulation (GDPR), including the right to object to processing and the right to lodge a complaint with a supervisory authority.
CCPA (California Users):
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what data is collected and the right to opt-out of data sales. We do not sell your personal information.
The availability of certain rights may depend on your location and applicable law.
8. International Data Transfers
We are based in the United States. If you use our apps from outside the United States, please be aware that information processed by us or our third-party service providers (such as advertising providers) may be transferred to, stored in, and processed in the United States or other countries.
These countries may have data protection laws that differ from those in your jurisdiction. Where required by applicable law, we take reasonable steps to ensure appropriate safeguards are in place for such transfers, including relying on protections provided by our service providers.

8A. Data Retention
We retain data only for as long as needed for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
- Locally stored app data (e.g., game progress, settings, statistics): Stored on your device until you delete the app or clear app data.
- Advertising-related data collected by third parties (e.g., AdMob): Retained according to the third-party provider's policies. We do not directly control or access this retention.
- Support emails and support requests: May be retained for a reasonable period to respond to your request, maintain records, and improve support quality.
- Account data (Carrots, if applicable): Retained while your account is active and as needed to provide the service, unless you request deletion (subject to legal requirements).
If you request deletion of data that we control, we will process the request within a reasonable time and in accordance with applicable law.
9. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information. While no system is perfectly secure, we take precautions to prevent unauthorized access, loss, or misuse of data.
10. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The "Last updated" date reflects the most recent revision. Continued use of our apps after changes are posted indicates your acceptance of the updated policy.
For significant changes to Smash'em Up!, we will provide an in-app notification.
